No construction and delivery of sold flats till dated since year 2010 clearly shows the intention of the builder. Investigation is required to determine where the funds collected for Neotown Greater Noida project have been routed to.

That the interim stay order on construction against builders in Patwari- Greater Noida (West) continued vide Hon’ble High court of Allahabad orders dated 28.01.2010, 04.05.2010, 11.08.2010, 07.09.2010, 13.09.2010, 04.10.2010, 16.11.2010, 01.12.2010, 12.01.2011, 05.04.2011 and 06.04.2011 in Re: Devendra Kumar and Others Vs. State of U.P. and Others, WRIT-C No. 500 of 2010 and other 31 connected similar WRIT Petitions related to illegal acquisition of land in Patwari, Shaberi and other villages.

That the Hon’ble High Court of Allahabad vide order dated 12.05.2011 in Re: Devendra Kumar and Others Vs. State of U.P. and Others, WRIT-C No. 500 of 2010 quashed the land acquisition of land in village Patwari thereby effecting the residential project which was in soft launch by the Patel Realty.

That the judgment of the Hon’ble Allahabad High Court dated 12.05.2011 was challenged by Greater Noida Industrial Authority in Hon’ble Supreme Court of India, but Hon’ble Supreme Court of India vide its judgment dated 06.07.2011 in Re: Greater Noida Industrial Development Authority Vs. Devendra Kumar & Ors, SLP(C) No. 16366/201, upheld the decision of Hon’ble High Court thereby holding land acquisition illegal and also directed, builders to refund the money of the buyers with reasonable interest.

In Page 345 of WRIT – C No. – 37443 of 2011 at Allahabad: Gajraj and Others vs. State Of U.P. And Others Hon’ble High Court of Allahabad held that:

“ Various applications have been filed by intervenors who were allottees of different Group Housing Plots and other allottees giving details of the activities taken by them after the allotment of plots. Following allotments have been claimed with regard to Village Patwari:

(I) M/s Patel Advance JV GH-03, Tech Zone IV. Date of allotment 27/4/2010. Date of possession 13/10/2010. It is claimed that project was sanctioned on 15/2/2011 and 04/3/2011. Number of dwelling units are 2270 and number of allottees are 1237. It is claimed that an investment of 75.22 crores have been made by the allottees……………………………..

“Hearing pertaining to village Patwari, including the hearing of interveners has been concluded. Regarding village Ghodi Bachhera and village Sakipur hearing has also been completed. One of the submissions of the learned counsel for the petitioner is that there has been no approval of the plan by the National Capital Regional Planning Board as required by National Capital Regional Planning Board Act, 1985. Reliance has also been placed on a decision of Hon’ble Apex Court in Writ Petition (Civil) No.67 of 2007, Jai Prakash Tyagi and others vs. State of U.P. and others, decided on 23.08.2011. ”

M/s Patel Advance JV contested to be intervener in the above mentioned Writ Petition and accordingly filed the affidavit before the Hon’ble High Court of Allahabad in Gajraj (Supra) which has been submitted to the Investigating Officer.
